Terms of Service — agent55

1. Scope
These terms apply to the use of agent55.ai and all communication related to agent55 (consultancy, workshops, coaching).
2. Services
agent55 provides:
- AI consultancy (Foundation, Automation, Agency ladder)
- AI workshops and training for teams
- Tailored advice for businesses and organizations
All services are offered on a personal basis, unless otherwise agreed.
Use of AI tools
agent55 uses professional AI tools (Claude, OpenAI, n8n, and related services) as part of the consultancy process. By agreeing to these terms and/or scheduling a call, you accept:
- The use of AI tools for analysis, recommendations, and strategy generation
- That information you share may be processed via these external services
- That you will not share sensitive information (trade secrets, passwords) — only share what's necessary for the engagement
- The privacy and retention policies of these AI service providers (see privacy statement for links)
3. Bookings and calls
- Calls can be scheduled via cal.com
- The standard intake call is 30 minutes and free
- Calls can be cancelled up to 24 hours in advance without penalty
- No-shows (failing to attend without notice) may affect future bookings
4. Confidentiality
Information you share during consultations will be:
- Treated confidentially — not shared with third parties without consent
- Retained — for the duration of the engagement + reasonable time after
- Secured — with standard security practices (HTTPS, encryption where applicable)
agent55 may:
- Use anonymized case studies for marketing (without company name or identifiable details)
- Request references after successful projects (with your permission)
5. Intellectual property
- All templates, frameworks, and tools used by agent55 remain agent55's property
- All work you create (documents, configurations, automations) remains yours
- Shared insights and recommendations can be freely used after the engagement
6. Limitations of services
agent55 is:
- Not a lawyer — for legal matters, consult a solicitor
- Not a financial advisor — for tax issues, consult an accountant
- Not a guarantor — we offer no guarantees on results, only on honest advice and professional work
- Not a Data Protection Officer — for GDPR compliance questions, consult a specialized attorney
About external AI tools:
- We use external AI service providers (Claude, OpenAI, n8n) under Data Processing Agreements
- agent55 carefully selects these providers, but cannot guarantee they won't misuse your data
- You accept the inherent risk of cloud-based AI processing by giving consent
7. Liability
agent55 is liable for:
- Our own gross negligence or willful misconduct
- Breach of confidentiality
- Improper processing of your data under our control
agent55 is not liable for:
- Indirect damage, lost profit, or business interruption
- Damage caused by incorrect implementation of our recommendations (your choice and execution)
- Damage caused by technical errors from external providers (Claude, OpenAI, n8n) beyond our selection standard
- Damage caused by your failure to secure sensitive data (e.g., shared passwords)
Maximum liability: amount paid for the specific service, unless otherwise required by law (e.g., GDPR-related damages fall outside this limitation).
8. Payment
- Consultancy pricing is clearly stated upfront
- Payment is made according to agreed terms (usually upfront for defined engagements)
- Late payment may delay projects
- No refunds after work is completed, unless we failed to deliver as agreed
9. agent55's intellectual property
You may:
- Use references to agent55's work on your own website (if accurate)
- Credit agent55 as the source of your AI strategy
You may not:
- Reproduce agent55's content, framework, or tools without permission
- Use agent55's name to suggest false associations
10. Termination
Both parties may terminate the engagement:
- By mutual agreement — rather than unilaterally
- Notice period: 2 weeks (or as agreed in the specific engagement)
- Paid services: you may receive refunds for undelivered hours, adjusted for work completed
11. Changes
agent55 may change these terms. Changes will be announced on this site. Continued use means acceptance.
12. Governing law
These terms are governed by Belgian law. Disputes will first be resolved through negotiation.
